Penny, assisted by the very talented Isobel Thomas, represented an individual who faced an allegation of fraud to the value of £700,000 concerning waste disposal. This was a very serious allegation which could have resulted in not just the loss of his business but also his liberty.

The excellent Kevin Toomey of 2 Bedford Row argued that the prosecution should be stayed, raising abuse of process on the basis that the main prosecution witnesses were corrupt and not witnesses of truth. Thankfully, the Court agreed with him and the prosecution was stopped by the Judge.
